T's & C's of Product Sales
BOTH BUYER AND SELLER ACCEPT THE FOLLOWIING CONDITIONS. AND RETURNS POLICY
In these terms and conditions "the Seller" or "the Company" means Estética Para Profissionais - Algarve Beauty School, or any subsidiary or associated company and "the Buyer" means the Purchaser of goods from the Seller under these terms and conditions.
Are correct at the time of printing but are subject to alteration without prior notice. All prices will be exclusive of IVA (VAT) at ruling rates and delivery costs.
Payment is due to the Company in full prior to despatch of goods.
Claims for loss or damage to goods in transit cannot be accepted unless the company is advised within 48 hours of receipt of goods in the case of damage. The Company must be informed, in writing, within 7 days of date of invoice in the case of loss. the Company will not entertain claims made outside the stated time limits.
When goods have been ordered in error or are not as expected, the Company may agree to their return on the following conditions:
a) A request must be made to Estética Para Profissionais within 7 days of receipt of goods.
b) If you wish to return unwanted goods please ensure that any product you have bought is in original condition, unworn or unused and sent mback to us with its original packaging. It is the responsibility of the Buyer to arrangefor the return carriage. Your statutory rights are not affected.
c) Any refunds given for returned goods will be subject to a handling charge of EUR 5 (five euros) per item/order, or 10% of the value, whichever is the greate.
d) Returned goods will only be accepted where a Returns Authorisation has been given. The Buyers/customer name must be quoted on accompanying documentation. For your own protection, please obtain a receipt from the carrier, as the company accepts no responsibility for lost parcels.
We try to deliver the in-stock goods within 48 hours however please contact the Company for an estimated delivery and price on application. Please note this delivery time is indicative only and we are not responsible for any delays. Neither Estética Para Profissionais or their designated carrier will accept claims for consequential loss due to late deliveries. Orders over EUR 50 (fifty euros) net value - free delivery within Portimao area.
Please note additional delivery charges apply on all furniture and equipment, prices vary depending on size and weight - final delivery POA (price on application).
If you require a special delivery, i.e., Saturday or AM, these can be quoted upon request.
The Company shall be entitled to cancel or delay delivery of orders if it is delayed, hindered or prevented from delivery through circumstances beyond its control. Such circumstances shall include (but are not limited to) industrial action, accident, fire, terrorism, Act of God or failure to deliver by suppliers or carriers.
We will be very happy to quote for export orders.
Prior to despatch, cancelllation will only be accepted on the following terms:
a) 5% handling charge on standard items.
b) Special non-standard items such as specialised equipment or salon wear cannot be cancelled and payment must be made iin full.
CANCELLATION AFTER DESPATCH CANNOT BE ACCEPTED
Any modification to orders must be confirmed in writing
Goods are sold on the understanding that they will only be used for their intended purpose. No responsibility will be accepted by Estética Para Profissionais, for untrained personnel using products supplied by us. All offers in the online product catalogue are subject to stock availability and we reserve the right to restrict or refuse any order of application for credit at any time. We take special care to show correct sizes and specifications and such descriptions whilst given as a guide, in good faith, are subject to alteration by the Seller withough notice.
RETENTION OF TITLE CAUSES
a) The risk in all goods passed to the Buyer upon delivery but title in the goods remains vested in Estética Para Profissionais, and shall only pass from the Company to the Buyer upon full payment being made of all sums (due on whatsoever account or grounds) to Estética Para Profissionais.
b) The Buyer agrees that prior to the payment of the whole price of the goods, Estética Para Profissionais, or appointet agents may enter the Buyer's premises to collect such goods should the seller request. Prior to such payment the Buyer shall keep the goods seperate and identifiable for the purpose, and return the goods to the Seller should the Seller request.
All items are guaranteed according to the manufacturer's warranty. All glass items are specifically excluded from this guarantee.
T's & C's of Courses and Workshops
i. ‘Organisation’ shall mean Estética para Profissionais
ii. ‘Programme’ shall mean any programme of training arranged by the organisation.
iii. ‘Learner’ shall mean any person accepted on a programme.
iv. ‘Enrolment’ shall mean any correctly completed enrolment form submitted by a learner for a programme.
v. ‘Fee’ shall mean the consideration payable for any programme including VAT charged at the prevailing rate when applicable.
i. Enrolment for a program must be made by completing an application form and enrolment form provided by the organisation.
ii. An enrolment will be deemed to have been accepted only when accompanied by the correct deposit.
iii. The organisation reserves the right to refuse any enrolment without supplying a reason.
Cancellation and alternatives
i. Should the organisation find it necessary to cancel or postpone any programme the learner will be offered an alternative programme or a refund of fees.
ii. The organisation reserves the right to provide an alternative venue and educator to those published.
i. Any deposit paid will be forfeited if the programme is cancelled by the learner.
ii. Training must be paid for in full once training has commenced even if the course is not completed.
Terms of Payment
i. The fee must be paid prior to the commencement of the programme unless agreed otherwise
ii. Payment can be made by:
BACS – Account No xxxxx, Sort Code xxxx
i. The organisation does not accept responsibility for any claims for consequential loss suffered by the learner following the cancellation or postponement of a programme.
ii. The liability of the organisation for the cancellation or postponement of any program shall be limited to the programme fee.
Liability – property
i. Whilst on the organisation’s premises or any other premises used by the organisation for a programme the learner accepts responsibility for their own behaviour and undertakes to indemnify the organisation against damages or personal injury caused to its servants agents or property as a result of its actions or defaults of the action of its learners
ii. The organisation does not accept responsibility for any harmful act or default by its servants or agents unless such act or default is reasonably foreseeable and avoidable by the exercise of due care on behalf of the organisation as its employer
The organisation reserves proprietary rights on all programme notes and material provided for a learner and no part of any programme notes of material may be reproduced or transmitted in any form or by any means electronic mechanical photocopying recording or otherwise stored in any retrieval system of any nature without the written permission of the organisation.
Acceptance of Terms
i. No variation can be made to these terms without the written consent of an officer of the organisation.
ii. These terms of business are deemed to be accepted by the learner by virtue of the completion of an enrolment form, attendance, compliance with coursework, Health & Safety and any other rules & requirements
